Legal Disclaimer - RSAutoDiagnostics
RSAutoDiagnostics' mileage correction service may only be used
for legal purposes, and you are confirming that this is the case when you arrange an appointment with
us. If you wish to sell your vehicle after RS-AutoDiagnostics has performed mileage correction services on it, it
is your legal responsibility to inform the purchaser that this process has been carried
out.
Correcting a false mileage
reading on the odometer of your personal vehicle is not illegal when this is done for legitimate reasons such as
because the odometer has become corrupted, or because you are replacing your odometer. RS AutoDiagnostics are fully complicit with the laws
regarding mileage correction. However, as the owner of the vehicle, you will be breaking the law if you fail to
inform a subsequent purchaser of your vehicle that the mileage on the odometer has been
corrected.
In the event that the mileage
reading on your vehicle’s odometer can not be guaranteed, you are legally obliged to place a disclaimer on the
odometer which is equal in size to, or larger than, the odometer itself. The disclaimer should be bold and
obvious, and should read something like ‘WARNING - CHECKS WERE UNABLE TO CONFIRM THE ACCURACY OF THIS
MILEAGE’.
RSAutoDiagnostics reserves the right to decline your
business if the vehicle has previously been tampered with, or to discontinue work that has already begun if we
discover that the dashboard shows evidence of tampering. We will only accept mileage correction instructions
from the registered owner of the vehicle.
RSAutoDiagnostics’ mileage correction service is to be used
at the customer’s own risk. We can not be held liable for issues that arise once the work has been
satisfactorily completed, or for issues involving components other that the odometer.
RSAutoDiagnostics can not be held liable for illegal use of
our mileage correction service. We are willing to correct an odometer for the following
reasons:
-
You have been in an
accident and the damage has corrupted your odometer
-
Your dashboard has been
vandalised and the mileage reading is now wrong
-
Your car has been
jumpstarted and this has corrupted the mileage reading
-
You have had to replace
your instrument cluster with a new or second hand unit and the odometer is displaying the wrong mileage
value
-
You have imported a car
and need to change the odometer reading from kilometres to miles
The following statement has been made by Trading
Standards:
“If an odometer reading is
found to be incorrect an offence may have been committed under the Trade Descriptions Act 1968 if the vehicle
was supplied to you or offered for supply to you in the course of a trade or business, And if a private
individual sells you a clocked motor vehicle then an offence may have been committed under the Theft Act 1968. A
breach of the Trade Descriptions Act 1968 is not a breach of contract. Should the trader involved be
successfully prosecuted the courts may award you some compensation, that being the difference in value between
the true and false mileages. You will find it very rare for the courts to order complete
reinstitution.”
